Anatel and Telefônica ink conduct adjustment agreement

Brazil's telecoms regulator, the National Telecommunications Agency (Anatel) and Telefônica Brasil have signed a Term of Conduct Adjustment (TAC) agreement.

Under the details of the agreement, it includes the processes related to the Quality and Users' Rights and Guarantees which has a reference value of approximately of R$435 million (US$86.2 million).

The agreement follows the news in December 2021, where Anatel's board of directors unanimously approved the implementation of this TAC, which was pending analysis by the Specializsd Federal Attorney at Anatel (PFE-Anatel). The TAC is expected to last for four years, until March 2026.

Under the terms of the TAC, Telefónica must carry out a series of improvements to the infrastructure of its network and promote a change in conducts, these include:

  • reimbursing users in accordance with the Obligation Non-Compliance Determination Procedures (Pados) contained in the TAC;

  • promote actions to affect the adequate treatment of reimbursement to users outside the base and deposit the remaining amounts to the Fund for the Defense of Diffuse Rights (FDD);

  • implement a Single Front End application that allows greater ease of service by the call centre;

  • implement technical procedures in the URA;

  • expand service in digital channels;

  • expand 4G service with the implementation of 337 Emergency Radio Beacons in 284 municipalities;

  • expand 4G capacity with the implementation of 1,204 carriers in 653 municipalities;

  • install equipment that makes it possible to increase network resilience and latency standards; and

  • achieve progressive goals of the Perceived Quality Index (IQP) nationwide and by Federation Unit, through consumer research for the purposes of the Quality Regulation of telecoms services.


The aforementioned R$435 million (US$86.2 million) reference value, includes investments of R$216 million (US$42.7 million) in additional spending on the development of three fibre optic backbone routes in the Northeast of Brazil, that will interconnect 42 municipalities – 25 of which do not currently have fibre, six are route ends and another 11 will be route passages – spanning more than 1,400km.
