French court gives victory to Orange after €3.3bn claim by SFR

Altice’s SFR has lost a legal case against Orange over use of Orange’s ducts in France to carry fibre.

SFR – which inherited the case from the Numericable cable TV company with which it merged in 2014 – was claiming €3.3 billion from Orange, but instead will have to pay Orange €300,000 in legal costs, according to the French newspaper Le Parisien, quoting an unnamed source.

Orange confirmed the victory to the Reuters news agency, but SFR did not comment.

According to Le Parisien, the case began in 2010 when Numericable wanted access to Orange’s ducts for its cable and fibre. Numericable claimed that Orange was hindering its access to the ducts.

An appeal court overturned an earlier judgement in favour of Orange in January 2016, but Orange has now had the decision reinstated.
