Telekom Austria acquisition of Orange Spectrum receives regulatory approval

Austrian regulator the Telekom-Control Commission (TKK) has approved Telekom Austria’s acquisition of frequencies from Orange Austria.

The deal is dependent on Hutchison Austria’s takeover of Orange Austria, which received conditional European Commission approval last week, and will see the sale of a total of 2x13.2MHz of paired frequencies.

This includes 2 x 3.2MHz of 900MHz spectrum, 2 x 5.0MHz of 2,100MHz spectrum and 2 x 5.0MHz of 2,600MHz spectrum.

Telekom Austria said that the acquisition is designed to improve the quality of its mobile network.

Other parts of the €390 million transaction include the acquisition of base station sites, the budget mobile provider, Yesss!, and certain intellectual property rights owned by Orange Austria.

The country’s competition regulator is reportedly set to appeal a decision to approve the overall transaction by the country’s cartel court, meaning it could face further delays.
